Toby W. Burke

Toby's undergraduate work was completed at Texas A&M University. He was a member of the Corps of Cadets at Texas A&M University and received an active duty commission promptly after receiving his accounting degree in 1986. After serving five years in the United States Army, Toby resigned his commission to start law school. He graduated magna cum laude from St. Mary's Law School, where he was on the Editorial Board for St. Mary’s Law Review.

Before joining Harrison Steck and moving to Fort Worth, Toby spent four years with a major insurance defense firm in San Antonio. In that practice, he defended insureds having commercial general liability coverage, and learned the ins and outs of insurance defense. This experience has served him well in his construction law practice at Harrison Steck, where he has been a partner for the last sixteen years.

Toby represents general contractors, subcontractors, and sometimes owners, in construction law trials and arbitrations. These matters have included construction defects, design defects, breach of contract claims, mechanic lien claims and bond claims. From his extensive experience with construction clients, he has also developed knowledge in dealing with OSHA complaints. He has tried citations for OSHA violations to administrative judges of the United States Department of Labor, and also appealed an administrative judge's ruling to the United States Fifth Court of Appeals. Before beginning his law practice, Toby sat for and passed all sections of the Certified Public Accountancy Exam. Because his practice has been law, and not accounting, he is not certified as an accountant. His background in this area, however, is extremely helpful in assisting construction clients with their business matters.

In 2016, Toby, along with two of his partners, became three of the first group of attorneys ever certified in construction law by the Texas Board of Legal Specialization. He is a member of the Construction Law Section of the Texas Bar Association and the Construction Law Section of the Tarrant County Bar Association.
